1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Borrower", "you", or "your") and EASTCASH LENDING CORPORATION ("EASTCASH", "Lender", "we", "us", or "our"), a duly registered corporation with the Securities and Exchange Commission (SEC Company Registration No. 2021060016536-20) and authorized to operate as a Lending Company under Certificate of Authority No. L-21-0010-95 pursuant to Republic Act No. 9474, operating the online lending platform known as EastCash.

By registering for an account, accessing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable Philippine laws and regulations governing lending and financial services.

If you do not agree with any provision of these Terms, you must immediately discontinue your use of our Services.

3. Account Registration and KYC

To access our lending services, you must create an account by providing your mobile phone number and completing the One-Time Password (OTP) verification process. You must then complete our Know Your Customer (KYC) verification, which includes submitting a valid government-issued ID, a selfie photograph for identity matching, and basic personal and financial information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion if we suspect fraudulent activity, identity misrepresentation, or violation of these Terms.

Submitting a loan application does not guarantee approval. All applications are subject to our automated and manual risk assessment process, which considers your credit profile, repayment history, employment status, income level, and other relevant factors. We reserve the right to approve, reject, or modify any loan application at our sole discretion.

Upon approval, the loan agreement will clearly state the principal amount, service fee, interest charges, total repayment amount, and due date. By confirming the loan, you agree to repay the total amount on or before the specified due date.

4.3 Disbursement

Approved loan amounts (net of applicable service fees) will be disbursed to your designated e-wallet (GCash or Maya) or bank account. Disbursement is typically processed within the same business day, subject to payment channel availability and processing times. EASTCASH shall not be liable for delays caused by third-party payment providers.

5. Repayment Terms

5.1 Repayment Methods

You may repay your loan through any of the following methods: GCash payment, Maya payment, QR code payment, or bank transfer to our designated account. Full repayment must be received on or before the due date specified in your loan agreement.

5.2 Late Payment and Overdue Penalties

Failure to repay on time will result in the following consequences:

The specific penalty interest rate will be disclosed in your loan agreement. Total charges (interest, fees, and penalties) shall comply with the interest rate ceilings prescribed by the Securities and Exchange Commission (SEC) and the Bangko Sentral ng Pilipinas (BSP).

6. Prohibited Activities

You agree not to engage in any of the following activities when using our Services:

Providing false, misleading, or fraudulent information during registration, KYC verification, or loan application; using another person's identity or documents to apply for a loan; creating multiple accounts to circumvent lending limits or blacklist restrictions; using automated tools, bots, or scripts to interact with our platform; attempting to exploit system vulnerabilities or interfere with the operation of our Services; using loan proceeds for illegal activities, money laundering, or terrorism financing; and any other activity that violates applicable Philippine laws or regulations.

Violation of these prohibitions may result in immediate account termination, loan acceleration (full amount due immediately), reporting to relevant authorities, and legal action.

7. Intellectual Property

All content, features, and functionality of our Services — including but not limited to the EastCash name, logo, website design, text, graphics, software, and underlying technology — are the exclusive property of EASTCASH LENDING CORPORATION and are protected by Philippine and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of our Services without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by Philippine law, EASTCASH LENDING CORPORATION shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to loss of profits, data, or business opportunities.

We shall not be liable for any delays, failures, or disruptions in our Services caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, internet service disruptions, government actions, or third-party payment provider failures.

9. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation between the parties.

If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to mediation or arbitration in accordance with the Alternative Dispute Resolution Act of 2004 (RA 9285). The venue for any legal proceedings shall be the appropriate courts of Cavite, Philippines.

10. Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website, in-app notifications, or email at least fifteen (15) days before they take effect. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must discontinue your use of our Services and settle any outstanding obligations.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
